Everfound is a product of Digital Bar LLC.

These Terms & Conditions ("Terms") form a binding agreement between Digital Bar LLC ("Digital Bar," "we," "us," or "our"), operator of Everfound ("Everfound," "the Service," or "the Services"), and the individual or entity ("you" or "your") that accesses or uses the Services. By accessing or using the Services, creating an account, running a preview or audit, or purchasing an audit or credit pack, you agree to these Terms. If you accept these Terms on behalf of a business, you represent that you have authority to bind it.

1. The Services

Everfound is an AI search visibility audit tool. It evaluates whether AI assistants and large language model search systems reference and cite a website, and produces a readiness score, diagnostic report, prioritized fix list, source kit, and related assets. Paid audits also include once-weekly monitoring and alerts for the audited site.

To perform an audit, Everfound analyzes the publicly available content at a URL you submit and sends queries about that site to third-party AI engines. Everfound reports what those engines return at the time of the audit.

Changes to the Services. Digital Bar may add, modify, suspend, or discontinue features of the Services at any time.

2. Accounts & Eligibility

Some features require an account. You are responsible for the accuracy of your registration information and for safeguarding your login credentials and all activity under your account. You must be at least 18 years old and able to form a binding contract to use the Services.

3. Plans, Pricing & Payment

3.1 Free Preview

A free URL scan and limited preview (a generated profile, example prompts, and an issue preview) is available at no charge.

3.2 Paid Audits

A paid audit unlocks the full reviewed report and deliverables (prioritized fix list, source kit, schema assets, and AI readiness brief) and a one-time re-audit of the same site. The price and inclusions are those shown at checkout on the Everfound pricing page.

3.3 Agency Credit Packs

You may purchase audits in bulk as prepaid credit packs. Each credit redeems for one audit and may be used for your own or client work. Audit credits do not expire. Pack sizes and pricing are those shown at checkout.

3.4 Billing

Paid audits and credit packs are charged at the time of purchase through our third-party payment processor (Stripe) using a valid payment method you provide.

3.5 Pricing Changes & Taxes

Digital Bar may change pricing at any time in its sole discretion. Current pricing is published on the Everfound pricing page; changes do not affect audits or credits already purchased. Prices may be subject to applicable taxes.

4. Refunds

Refunds are governed by the Everfound Refund Policy published on our website, which is incorporated into these Terms. In summary:

If a paid audit fails to produce your report due to a technical error on our side and we cannot promptly fix it, you receive a full refund.
Because an audit is a one-time analysis whose cost is incurred when it runs, delivered reports are not automatically refundable. If a delivered report did not do its job, email us within 14 days and we will make it right with a re-run, a credit, or a refund, depending on what went wrong.
Unused agency-pack credits are refundable pro-rata within 14 days of purchase; spent credits are treated as delivered audits.
Approved refunds are returned to your original payment method via Stripe, typically within 5–10 business days.

5. No Guarantee of Results; AI Disclaimer

5.1. Everfound measures and reports what third-party AI systems return at the time of an audit. Those systems are probabilistic, change frequently, and are outside Digital Bar's control. Results will vary over time and between engines, and re-running an audit may produce different results.

5.2. Digital Bar does not guarantee any particular AI visibility, citation, mention, ranking, share of voice, sentiment, traffic, or business outcome, and does not guarantee that implementing any recommendation will change how AI systems treat your site.

5.3. Audit outputs, scores, competitor comparisons, sentiment readings, and recommendations are AI-generated, may be inaccurate or incomplete, and are provided for informational purposes only. You are solely responsible for reviewing them and deciding whether and how to act on them.

6. Third-Party AI Engines & Services

The Services depend on third-party AI engines, hosting, and infrastructure. Digital Bar is not responsible for the availability, accuracy, changes, pricing, or policies of these third parties. Their outputs are theirs; Everfound reports them. Digital Bar may add, remove, or change the AI engines and providers it uses at any time in order to deliver the Services. Any third-party site or service referenced in a report is governed by that third party's own terms.

7. Acceptable Use

You agree not to:

Use the Services in violation of applicable law or any third party's enforceable terms;
Reverse engineer, scrape, overload, probe, or attempt to extract the platform's models or underlying systems;
Resell, redistribute, or provide the Services to third parties except through an authorized agency credit pack;
Misrepresent audit results or attribute fabricated or altered results to Digital Bar or Everfound;
Use the Services to harass, defame, or unlawfully harm any person or business.

8. Intellectual Property & Your Reports

8.1. Digital Bar owns all intellectual property in the Services, including the software, models, scoring methodologies, user interface, and documentation.

8.2. Subject to these Terms and payment of applicable fees, Digital Bar grants you a non-exclusive, non-transferable license to use the reports, scores, and deliverables generated for you for your own internal and client business purposes.

8.3. The URLs and any inputs you submit remain yours. You grant Digital Bar a limited license to process them solely to provide and improve the Services. Any feedback you provide may be used by Digital Bar without restriction.

9. Privacy

Everfound collects limited personal information, such as your account and payment details and the URLs you submit. Our handling of personal information is described in the Digital Bar Privacy Policy. Everfound analyzes publicly available website content and does not require you to upload your own customers' personal data.

10. Disclaimers

The Services are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. No uptime, performance, or support level is guaranteed unless expressly stated in a separate written agreement.

11. Limitation of Liability

11.1. To the maximum extent permitted by law, Digital Bar's total liability for any claim is limited to the amount you paid for the specific audit or credit pack giving rise to the claim in the 12 months preceding the claim. For free-preview use, that amount may be zero.

11.2. Digital Bar is not liable for indirect, incidental, consequential, exemplary, or punitive damages; lost profits, revenue, or business opportunities; AI inaccuracies or hallucinations; or third-party AI engine, hosting, or infrastructure failures, changes, or outages.

11.3. These limitations apply regardless of the theory of liability, including negligence.

12. Indemnification

You agree to indemnify and hold harmless Digital Bar LLC from claims, damages, losses, and expenses arising from your use of the Services, the URLs or content you submit, your use of audit outputs (including competitor or comparative data), or your violation of these Terms or applicable law.

13. Changes to These Terms

Digital Bar may modify these Terms from time to time. Material changes will be communicated via the Service or by email, and your continued use of the Services after changes take effect constitutes acceptance.

14. Governing Law; Dispute Resolution; Arbitration

14.1. These Terms are governed by the laws of the State of Vermont.

14.2. Any dispute arising under these Terms shall be resolved through binding arbitration in Vermont, administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Either party may seek injunctive or equitable relief in a Vermont court, and either party may bring an eligible claim in Vermont small claims court.

14.3. All disputes will be resolved individually. You and Digital Bar waive any right to participate in a class, consolidated, or representative action, and the arbitrator may not consolidate claims or preside over any class or representative proceeding.

15. General Provisions

No Personal Liability. Digital Bar's owners, members, managers, officers, and employees have no personal liability under these Terms.

No Third-Party Beneficiaries. There are no third-party beneficiaries to these Terms.

Force Majeure. Digital Bar is not liable for delays or failures due to events beyond its reasonable control, including third-party AI engine or infrastructure outages.

Assignment. You may not assign these Terms without Digital Bar's consent.

Severability. If any provision is held invalid, the remainder stays in effect.

No Waiver. Rights are not waived unless in writing.

Entire Agreement. These Terms, together with the Refund Policy and Privacy Policy, are the entire agreement for your use of the Services and supersede prior proposals and agreements.
